Contest entry period: January 1 – December 31, 2015

THE CONTEST PERIOD & SPONSOR

1. The “Win $10,000 Towards Your Dream Wedding” contest (the “Contest”) is run by The Chelsea Hotel in Toronto ON, also referred to as the “Contest Sponsor and Administrator”. The contest will commence on January 1, 2015 at 12:00:01 AM (ET) and will run until December 31, 2015 at 11:59:59 PM (Pacific Time) (the “Contest Period”).

CONTEST GROUP ENTITIES

2. For the purposes of this Contest, the Contest Group Entities are The Chelsea Hotel Toronto (in Toronto, ON), together with any participating affiliates, advertising and promotion agencies, suppliers of materials and services related to the Contest, and any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Contest (collectively, the “Contest Group Entities”).

ELIGIBILITY

3. The Contest is open to residents of the province of Ontario, Canada who are the age of majority and who are residing in Ontario, Canada at the time of contest entry and the Grand Prize draw. For greater clarity, any person residing outside of Ontario, Canada during the contest entry and draw periods is not eligible to enter. An entrant who is below the age of majority must have the consent of his/her parent or legal guardian to submit his/her personal information in order to enter the contest. If a parent or legal guardian does not provide consent, the entrant will be disqualified.

Current and former employees of the Contest Group Entities, their affiliates, advertising and promotional agencies, service providers, prize sponsors, contest judges, their immediate family members and those domiciled with them are not eligible to enter.

HOW TO ENTER

4. ELIGIBLE ACTIVITIES: An eligible entrant will automatically receive one (1) Grand Prize Entry for each eligible wedding booking (defined below) that is performed in compliance with these Rules (as determined by the Sponsor in its sole and absolute discretion). Weddings may be booked by contacting the Wedding Specialist for an appointment at 416-585-4340.

a. Eligible Bookings for a Contest Entry: To be eligible, a wedding must be booked at the Chelsea Hotel Toronto during the Contest Period (January 1 – December 31, 2015) by an eligible entrant (bride or groom) in compliance with the terms and conditions of the Contest Sponsor. The eligible wedding must take place in the calendar year of 2016 and also meet the following criteria:

  • The booking is for one of the following wedding packages*: Chelsea Silver, Gold, Platinum or Enchanted Buffet package
  • There is a minimum of 50 guests
  • A deposit of 25% of the estimated wedding invoice has been made
  • The wedding is not cancelled either before or after the Grand Prize Draw takes place
  • Exclusions: Other vendor services, hotel room reservations and parking are not eligible for a contest entry.

NO PURCHASE IS NECESSARY TO ENTER. A PURCHASE (BOOKING A WEDDING AT THE CHELSEA HOTEL TORONTO) WILL NOT INCREASE YOUR ODDS OF WINNING.

b. Mail-in No-purchase Contest Entry: An eligible entrant may obtain a Grand Prize Entry without having to make an eligible purchase or book a wedding in advance by submitting a Mail-in Request in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion).

To obtain a contest Mail-in No-Purchase Entry, the entrant must legibly hand print his/her full legal name, complete home address (including postal code), date of birth, home and cell telephone numbers, email address, the name of the contest he/she intends to participate in and a unique and original essay (in English or French) of at least 500 words (and no more than 750 words ) on the topic “Why the Chelsea Hotel is the best hotel in Toronto for a Wedding” on a plain white piece of paper and mail it (in an envelope with sufficient pre-paid postage) to Wedding Contest Entry c/o Chelsea Hotel Toronto, 33 Gerard Street West, Toronto, ON M5G 1Z4, Att: Director of Catering.

To be eligible, a Mail-in Entry must be mailed by Canada Post, post-marked during the Contest Period and received by no later than 5 business days after the close of the applicable entry period. The Sponsor will not be responsible for any lost, stolen, photocopied, delayed, illegible, damaged, misdirected, late or destroyed Mail-in Entries. If a Mail-in Entry is submitted and received in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion), the applicable entrant will be eligible to receive one (1) Grand Prize Entry. By submitting a Mail-in Entry, the applicable eligible entrant agrees to be legally bound by these Rules. Contest Entries will not be accepted by fax or email.

5. There is a limit of one contest entry per bride or groom; duplicate entries, incomplete entries, and entries with falsified information will be disqualified. The decision to disqualify any entry is at the sole discretion of the Contest Sponsor and Administrator, and will occur without notice or communication to the entrant. The disqualification decision is final and not subject to review.

Only one (1) home address and (1) email address may be used by any person who enters the Contest. All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.

In the event of a dispute regarding the identity of an entrant, the entry will be deemed to have been submitted by the authorized resident at the address given, and holder of the email address at the time of entry. For these purposes, the “authorized holder” is the natural person who is assigned to the submitted email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address on the Entry Form.

All entries must be received no later than December 31, 2015 at 11:59:59 PM (Pacific Time). Late entries will be disqualified. There is no fee to enter this contest, and no purchase is necessary.

THE GRAND PRIZE DRAW

6. One (1) random Grand Prize Draw made up from all the eligible entries will take place on February 6, 2016 at 1:00 PM (Eastern Time) in the management office of the Chelsea Hotel Toronto, 33 Gerard Street West, Toronto, ON M5G 1Z4. The draw will be conducted by the hotel’s Director of Catering or other designated person.

THE PRIZE

7. The Grand Prize: There will be one (1) Grand Prize awarded which consists of a $10,000.00CAD Chelsea Hotel Toronto catering credit to be applied towards the winner’s invoice for an eligible wedding package (Eligible wedding packages are: Silver, Gold, Platinum or Enchanted Buffet) scheduled to take place at the Chelsea Hotel Toronto in the calendar year of 2016. The Grand Prize catering credit will be applied solely towards the winner’s wedding catering package (including applicable taxes and 15% gratuities), and may not be used towards the cost of alcoholic beverages or any other wedding-related costs such as hotel room nights, room service, parking, mini-bar, hotel restaurant, hotel bar, laundry, phone or long distance charges, merchandise, other miscellaneous hotel expenses, or transportation. For greater certainty: If the cost of winner’s wedding catering package (including applicable taxes and gratuities) exceeds the $10,000.00CAD catering credit, then the winner is responsible to pay the outstanding balance. If the catering credit of $10,000.00CAD exceeds the cost of the winner’s wedding catering package (including applicable taxes and gratuities), then the un-used portion of the catering credit will have no redemption value in either cash or credit, and will be forfeited.

If the winner’s Chelsea Hotel Toronto wedding is cancelled before or after the Grand Prize Draw or the wedding does not take place within the required dates, the prize will be forfeited and the Contest Sponsor may elect to draw another winner. The Grand Prize must be accepted as awarded, and no deviation is allowed. The Grand Prize is non-transferable to another person, may not be applied towards another event at the Chelsea Hotel Toronto, and is not redeemable in part or in full for cash or as a credit on a credit card.

Awarding the Prize: The Chelsea Hotel Toronto’s Director of Catering will contact the selected entrant by telephone and email within three (3) business days of the prize draw. If for any reason the selected entrant cannot be reached after three attempts, and does not respond within three (3 days) of the final contact attempt, or is unable to accept the prize as awarded, his/her entry will be declared null and void, and the Contest Sponsor reserves the right to select at random another eligible entry.

The Contest Sponsors will not be held responsible for the loss of prize due to changes in mailing addresses, errors in completed Entry Forms or any other circumstances leading to an invalid, erroneous or incomplete phone number, mailing address or email address. After signing the Contest Declaration and Release Form and correctly answering unaided a mathematical skill-testing question, the Grand Prize will be awarded when the winner’s wedding is invoiced.

TO BE DECLARED A WINNER

8. To be declared a winner of the Grand Prize (a “Winner”), the selected entrant must, in addition to meeting the Contest eligibility criteria and otherwise complying with the official Contest rules, first:

  • Be reached by telephone or email by the Contest Sponsor’s representatives within the three (3) business days immediately following the selection of the entry (3 attempts will be made, 3 business days apart);
  • Complete and sign the Sponsor’s form of Declaration and Release including the permission and signature of a parent or legal guardian if the selected entrant is below the age of majority in Ontario, and return it to the Sponsor or its representatives by mail at Chelsea Hotel Toronto, 33 Gerard Street West, Toronto, ON M5G 1Z4 Att: Director of Catering by the deadline date provided on the release form.
  • Correctly answer, un-aided by mechanical means, a mathematical skill-testing question printed on the form of Declaration & Release.
  • Disqualification: If any one of the above mentioned conditions is not met, the selected entrant will be disqualified and shall not be entitled to receive the prize. The Contest Administrator reserves the right, in its sole and absolute discretion, to verify the information on the contest entry form of any selected entrant, and if any information if deemed to be false, the Administrator reserves the right to draw another eligible entrant as a potential prize winner.

GENERAL TERMS AND CONDITIONS

9. Verification of Entries: The validity of any Contest entry is subject to verification by the Sponsor. Any incomplete or fraudulent entries will be rejected. Any entrant or other individual who enters or attempts to enter the Contest in a manner which is contrary to these official Contest Rules or which is otherwise disruptive to the proper operation of the Contest or by its nature is unjust to other entrants or potential entrants will be rejected and that entrant or purported entrant will be disqualified. All decisions of the Contest judges, who may be employees or independent contractors of the Sponsor and Contest Administrator, with respect to any and all aspects of the

Contest, including without limitation the eligibility or disqualification of entrants or entries, are final and binding without right of appeal.

10. The Odds: The odds of winning depend upon the number of eligible entries received.

11. Acceptance of Prize: The Grand Prize must be accepted as described in these rules and cannot be transferred to another individual, substituted for another prize or exchanged in whole or in part for cash or credit. If for any reason a selected entrant cannot be reached through the contact information provided, or does not respond to the contest sponsor within three (3) attempts of three (3) days each of being contacted, or if there is any reason a winner cannot accept the prize as awarded, his/her entry will be declared null and void, and another eligible entrant may be randomly drawn from among the remaining eligible entries.

12. Substitution of the Grand Prize: The Sponsor reserves the right, in its sole and absolute discretion, and for any reason whatsoever, to substitute the Grand Prize, or any part thereof with an alternate prize of equivalent value.

13. Other Termination of Contest: The Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, terminate or suspend the Contest, in whole or in part, in the event of any cause or circumstance, including without limitation any virus, computer bug or unauthorized human intervention or any other cause that is beyond the control of the Sponsor, that could corrupt or affect the administration, security, impartiality or normal course of the Contest.

14. Release and Exclusion of Liability: By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees: (i) to release, discharge, and forever hold harmless the Contest Group Entities, and their respective officers, directors, employees, shareholders, agents and other representatives (collectively, the “Releasees”) from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant’s participation or attempted participation in the Contest, compliance or non-compliance with these Contest rules and acceptance and use of the Grand Prize or any portion thereof; and (ii) if selected as a potential Prize winner, to sign the Sponsors’ form of Declaration and Release documentation in this regard before receiving the Prize.

The Releasees will not be responsible for lost, incomplete, late or misdirected entries or for any failure of the Contest website during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting injury or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. (iii) The winner must sign a release form, giving the Contest Group Entities permission to publish in print, broadcast or online, the winner’s name and likeness without remuneration.

15. Name/Image of Winners: By entering the Contest, the winner agrees to abide by the Contest rules and authorizes the Sponsor and its advertising and promotional agencies and their respective employees or other representatives to broadcast, publish and otherwise use his or her name, photograph, image, statements regarding the Contest or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration, including without limitation, in print media or on social media or on any website operated by or on behalf of the Contest Sponsor.

16. Communication with Entrants: No communication or correspondence will be entered into with any Contest entrants, other than with the entrant selected in the Grand Prize draw.

17. Personal Information: The personal information gathered from contest entrants in connection with this Contest will be kept in a secure and confidential database, and will not be rented or sold. Personal information

of the contest entrants will be used for the administration of this Contest for the purposes of this contest only. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Registration and in the course of qualifying for an Entry for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy available at:

This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information. 18. General: All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of an entrant and/or the Sponsor in connection with the Contest, shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. This Contest is void where prohibited, and is subject to all applicable Federal, Provincial and Municipal laws.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the short rules, the mail-in no-purchase entry form, website, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

*Wedding Packages: The Chelsea Hotel Toronto Silver, Gold, Platinum and Enchanted Buffet wedding packages are differentiated based on the menu choices offered, and the price per person. Special benefits included in the wedding packages are preferred vendor discounts, complimentary entrée tasting, complimentary rehearsal room, preferred room rates for guests, discounted photography package, on-site wedding planner, complimentary parking for the bride and groom, complimentary parking passes for the wedding party on the day of your event, special flat rate parking for your guests, framed seating plan on an easel, wedding guest book and more.
